Thanks to his previous unique and varied work/life adventures, Nicholas Davies is well regarded today as an astute, strategic thinker who can just as comfortably work under fire in the courtroom as navigate through calm negotiations to help people resolve their conflicts and move forward.

In or out of the courtroom, Nicholas Davies serves as a grounded, level-headed, tenacious and respected family lawyer in BC. His prior experience working in the Canadian Armed Forces, in the offshore oil industry based in the Canadian Arctic, and as a Whistler Mountain ski patroller, in addition to his background as a boxer and airplane and glider pilot, has provided him with insightful, social perceptiveness, critical thinking, and problem-solving skills, which complement his legal training and many years representing family law clients.

With over 30 years of experience in family law, family law mediation, real property transactions and disputes, and corporate/commercial transactions and disputes, Nicholas Davies currently focuses his practice on family law and corporate/commercial litigation. His knowledge of complex property transactions is a particular asset for high net worth couples working to untangle the financial aspects of their relationship.

When Nick is not at his desk working or eating one of his favourite foods (sushi!), you can find him guest-instructing in the PLTC program on real estate and family law topics as well as regularly judging in the PLTC moot court program. He is also an active Rotarian and has served as president of his Rotary Club.

SELECTED DECISIONS

B.C. appeal court clarifies method for calculating income for child support for incorporated payors. Ruling ensures similar treatment of assessing support even if payor has an incorporated business.


Baryla v. Baryla, 2019 BCCA 22 – Nick Davies successfully obtained a new trial on appeal after we challenged the amount of a compensation payment, the failure to deal with distributive taxes, and the awarding of spousal support after an equal division of assets. It was necessary for the court below to determine whether the registration of title in joint tenancy was an inter vivos gift to the husband, and to account for distributive taxes upon division of the assets. The question of spousal support after an equal division of assets must consider whether an award would amount to “double dipping”.
