  • The property regime under the Family Law Act, S.B.C. 2011, c. 25 (the “FLA) entitles each spouse to one-half of all property (except defined excluded property) owned by at least one spouse at the time of separation. This includes property beneficially owned and any increase in the value of excluded property over the period of the relationship (s. 84).
  • Importantly, an accurate assessment of the property and value each party brings into the relationship is critical to assessing what the consequences may be on a later separation.
  • Ensure full disclosure of all assets, including bank and investment accounts, pensions, accounts receivable, intellectual property, interests in trusts, and cash surrender value of life insurance or other life insurance. Insist on values being either agreed upon or confirmed by appraisals or valuations.
